1. Definitions

In these terms:-
"You" and "your" refer to the person who buys or has agreed to buy goods from us. "We", "our" and "us" refer to Home And Garden furniture and AEB Solutions, our employees and agents.
N.B. Throughout these Terms and Conditions none shall in full or part override or affect your statutory rights.
2. Variations
Neither you nor we may alter the terms of this agreement without the agreement of the other. If you require any changes, please make sure that you ask for these to be put in writing and confirmed to you. This is to ensure that you can avoid any problems surrounding what you have agreed and what is expected of us. No agreement verbal or otherwise contradicting these terms will be accepted without written confirmation.
3. Order Waiting Time
Although we cannot specify the precise date of delivery at the time that you place your order, you will be given an approximate waiting time. Your goods will, except in circumstances beyond our control, be available to deliver to you within a reasonable time frame based on the original estimated date. If events or circumstances outside our control affect the original estimated delivery date beyond a reasonable time, we will inform you.

4. Place, Terms and Time of Delivery
We regret that we are unable to give a specific time of day for delivery. We will do all that we reasonably can to meet the date given for delivery. In the event of our failure to deliver due to unforeseen circumstances beyond our control, we will contact you immediately we become aware of the problem and arrange an alternative delivery date, within one calendar month of the original scheduled date. A refund will only be made if the item cannot be delivered within reasonable time of the original delivery date.

It is our responsibility to ensure that the goods are delivered to the entrance of the premises specified by you. All national courier deliveries will be delivered on a door to door basis ONLY.
Goods may also be collected from our warehouse but we must receive reasonable notice should you wish to do so.
We expect our employees or agents to exercise reasonable standards of care at all times. You will not suffer as a result of their proven neglect, negligence or dishonesty. Please tell us as soon as you can if there are likely to be any problems that may affect your delivery, such as access issues or unavailability. We will not deliver any goods if access is denied or it is not safely possible. We will not normally remain at a delivery site for more than 20 minutes. If we are not able to deliver the goods in this time due to your fault or something about which you knew but did not tell us 48 hours prior to the scheduled delivery date, you will have to pay a further delivery charge, exact to the cost to us for the aborted delivery. You may also be liable for reasonable storage charges from the date of an abortive delivery set out at 10 below that arises because of circumstances that were within your control. Where the abortive delivery results from circumstances within your control we will charge you for redelivering the goods at our normal delivery charge incurred by us for the distance of the delivery. In any event, if delivery is not possible, we will arrange with you, to make a delivery to another address and/or on another date. In most cases the delivery driver will not be able to offer a revised delivery time or date on site because of pre-booking lists. With your assistance we will arrange a new delivery date as soon as possible after the originally abortive attempt, as we want the goods to be in your possession as quickly as possible.

All delivery are sent insured against damage. All items need to be checked within 48 hours of delivery for any damage. Reports of damage after this time may not be covered under warranty. By agreeing to these terms you agree to check for all product damages and the items acceptability during this initial 48 hour period and report any concerns immediately upon discovery.


The cost of a return and arrangement is in the hands of the customer for any reason other than product fault. You must inform us first of any return for it to be accepted and given a reference number.
Should you wish for us to collected the item this can be arranged at a fee. Any refund made on the original order will be less the delivery fee charged to us by the delivery company (proof can be provided on request) and a restocking fee of up to 20% for handling and re conditioning of goods
5. Price
The price is in £ Sterling and includes Value Added Tax and other taxes, duties or tariffs.

6. Terms of Payment
We will normally ask for full payment of goods at the time of entering this agreement or before delivery , payment of the total price is payable prior to delivery by us. If you have a claim against us you cannot withhold more than the value of goods that have not been received by you at that time. Payment for goods to be delivered within the United Kingdom must be by cleared funds prior to delivery, or we will be unable to deliver to you. Acceptable methods of payment are cash, bankers draft, building society cheque, credit card and debit card, but please note that sufficient time must be allowed for bankers drafts, building society cheques and personal cheques to clear prior to delivery. If you wish goods to be delivered outside the United Kingdom, please discuss payment with a member of staff. Unless otherwise agreed, payment must be in full and in £ Sterling to us no later than three working days before we despatch the goods to you. To protect your security and to prevent credit card fraud where possible, we reserve the right for proof of ID on all purchases. If the delivery address and billing address are different, or to enable us to carry out necessary security checks, you may be asked to provide two proofs of address, which would ideally come from utility bills e.g. council tax, gas, electric, etc. We can only accept originals - NOT copies.
7. Ownership
The goods remain our sole property until full payment has been received by us at which time title passes to you. You will be responsible for the care of the goods once you have received delivery of them.
8. After Sale Service
We will replace or where appropriate repair any goods that fail within twelve calendar months of delivery by reason of faulty materials or workmanship, provided that you notify us within a reasonable period of the failure. We can only provide service to an address in mainland Great Britain. Please note that we will charge you for our reasonable but full expenses incurred in dealing with unfounded claims made. In all cases remedies offered by us shall not affect your statutory rights or our statutory responsibilities.
9. Limitations
We will not pay for:-
Fair wear and tear or damage caused by negligence and/or improper use (unless it is our suppliers' or our own negligence or improper use). Damage that occurs as a result of repairs or alterations made without our approval. Loss or damage relating to your business.

10. Storage
It is our policy to deliver goods to you as quickly as we can. In return we expect you to assist us to arrange the delivery date promptly once you are advised that the goods are available. We would normally expect you to confirm with us a mutually acceptable date for delivery within 72 hours of you being notified that the goods are ready for despatch. The result of unnecessary delays is additional costs arising, which we can charge to you for storage and insurance of the goods you have ordered currently being £4.00 per day per order if, you are present to make delivery arrangements and fail to do so within seven days of notification. If this charge is imposed we will provide an invoice. Any charge for storage and insurance will be subject to the terms of payment set out above in clause 6.
11. Cancellation
Under The Distance Selling Regulations, customers who have purchased goods from us are allowed a seven working day "cooling off" period in which to cancel any order. If you wish to take up this option you must let us know within this period, either by  e-mail or by sending written notice to us at the company address in the order confirmation. In any dispute proof of cancellation must be provided and in this respect you are advised to keep a copy of all correspondence sent, together with proof of despatch/order where applicable. The return of all goods is at the responsibility and duty of the purchaser, should you wish for us to collect the items this can be arranged and become payable by you before any collection. Collections are charged at our incurred rate depending on location.

A restocking fee of up to 20% of the total order value will also be charge for any returns for concerns not related to product quality. For example but not exclusive to reasons such as improper sizing or measuring of available space, incorrect item ordered or general change of mind
12. Severability
Each of these terms is severable. This means that if one term is not considered to be legally enforceable, that will not necessarily mean that the other terms are not enforceable.
13. Data Protection
Please note that the provision by you of personal data on this form infers your consent to the transfer of details relating to your purchase(s) including your name address and telephone number to the warranty administrator and between any other authorised party involved in processing any subsequent claim that you may make. We will also be entitled to use personal data held by us for accounting, statistical or marketing purposes or any other reasonable purposes connected with our business.

14. Notices
Any notices that we need to give you will be sent by post or fax to your last known address (or registered office if you are a limited company).
Notices will be considered to be served two working days after they are sent.
Products and descriptions
The information contained in our website is intended for guidance only and products/prices described in it are subject to change without notice.
We reserve the right to withdraw any offers without prior notice.
Website functionality
We do not guarantee that our website will be compatible with all hardware and software which may be used by visitors to the site. If you experience any difficulty using our website, please contact the webmaster.
Credit Card Security
All credit card numbers are destroyed immediately after an order is placed to ensure the utmost security, we will never store any payment information on our systems or on file.

1.    The guarantee applies to the original purchaser from the date of purchase and covers manufacturing faults and defects only. LeisureBench at their discretion will repair/refresh/replace the failed item.
2.    The standard guarantee is for three years from date of purchase
3.    Some products are not covered (please see notes)
4.    LeisureBench reserves the right to substitute failed product with a similar item should the original product/colour no longer be available. The replacement product does not extend the original guarantee period.
5.    The guarantee specifically excludes failure to observe reasonable care, maintenance and assembly. Willfull damage.
6.    The guarantee does not cover deterioration due to usual weathering process such as fading, and checking (natural cracks appearing in timber).
7.    Finishes on products are not covered by this guarantee as the life and performance of the finish is determined by care and the environment in which the product is used.
1.    Products not covered by the commercial guarantee, unless stated otherwise, include, Parasols, Heaters, cushions, glass and those marked with * to the right of the codes. E.g. code*
2.    Aggressive cleaning products should not be used on any product surface.
3.    Timber is a natural product and will expand and contract in changing climatic conditions. This may lead to slight cracking which is perfectly normal and does not affect the longevity and structural strength of the product.
4.    Some fixings such nuts and bolts may need occasional tightening. This should be seen as normal maintenance.
5.    LeisureBench will not accept responsibility for damage caused by application of any oil, varnish, wood stain or cleaning products unless supplied or recommended by LeisureBench.
6.    This guarantee does not cover damage caused by events such as natural disaster, infestation, wind/flood/fire or glass breakage. LeisureBench cannot be held responsible for events outside of their control.
This guarantee does not affect your statutory consumer rights.
